Welcome to Fishing Frenzy: Sea World (hereinafter referred to as "the game") provided by [Homeland Interactive Entertainment & Technology Limited] (hereinafter referred to as "we")! In addition to the User Service Agreement, we will further explain to you in detail the collection, use, storage and sharing of personal information, and your rights and obligations in relation thereto through our Privacy Protection Policy (the "policy") when you use the Fishing Frenzy: Sea World game. If you are a minor, please read this policy with a guardian.

Please read this policy carefully. When you tick the box, agree or use this game service, it is deemed that you are aware of the content of this policy and agree to sign this policy.

 

1. Information we collect

In the course of your use of the Fishing Frenzy: Sea World Game Service, we will collect information that you voluntarily provide or as a result of your use of the Service in the following manner, in order to provide you with and optimize our services and to protect the security of your account:

1.1 When you register or use the Fishing Frenzy: Sea World game service, we will collect your network identification information and personal device information, which will be used to mark you as a user of the game. If you use a third-party platform and account to download and log in to Fishing Frenzy: Sea World, we will collect your unique identification, avatar and nickname, which will be used to save your login information so that you can log in on different devices.

In order to provide you with better game services and improve your gaming experience, we may collect your nickname, avatar, operation information and game information in Fishing Frenzy: Sea World (hereinafter referred to as "such information", including but not limited to your login status, battle information/status, and achievement information) from your game account, and may show such information to you or other users. Depending on the game product, we may provide you with the relevant permissions so that you can choose whether to display the aforementioned information accordingly.

1.2 To comply with the relevant laws, regulations, policies, and requirements of the competent authorities in Vietnam, users of Fishing Frenzy: Sea World are required to perform real-name authentication to continue accessing and enjoying the game. We will collect your real-name identity information (including name and ID number) only after obtaining your consent or when you voluntarily provide this information. This information is classified as sensitive. Refusal to provide real-name identity information may result in your inability to log in to the game or restrictions on using the game's certain features. If you are not a user located in Vietnam and will not be accessing the game in Vietnam, you may disregard this real-name authentication requirement.

1.3 To ensure the operation of our services, maintain the basic functionality of the game, optimize the performance of our game products, improve your gaming experience, and safeguard your account security, we will collect the following information: your device ID, device name, device type and version, system version, IP address, device identifiers (such as IMEI/IDFA/OpenUDID/GUID/SIM card IMSI, MAC address), application ID, and network type.

1.4 When you use the game service, we will collect your game log information, such as login logs, item logs, game match information, so that you can view your game history in the client, and also for the analysis of game operation statistics, customer service complaint handling and other game security analysis. You need to authorize the permission to write and read your external storage, which is used for reading and storing game data, downloading apk updates, and helping you to store and share exciting moments. In order to enhance your gaming experience, we may synchronize the aforementioned information to subsequent versions of the game or other products provided by us that you are using.

1.5 In order to ensure the safe and stable operation of the game and to realize certain functions, the game may access the Software Development Kit (SDK) developed by a third party. We will conduct security monitoring of the SDKs accessed by the game that involve the collection of personal information in order to ensure the security of your personal information. For details, please see the attached "Third Party SDK Catalog Accessed by Fishing Frenzy: Sea World".

1.6 When you use the consumption function of this game, we will collect your top-up record and consumption record information so that you can inquire about your transaction records, and at the same time ensure the safety of your virtual items to the greatest extent possible. Top-up records and consumption records are sensitive information, and the collection of such information is necessary for the realization of the game's consumption function, otherwise the transaction will not be completed.

1.7 In order to ensure the security of your game account and create a fair, healthy and safe gaming environment, we will collect your game identification information, hardware and operating system information, process and game crash record information to combat behaviors that undermine the fair gaming environment or interfere with or disrupt the normal operation of the game services (e.g., for detecting piracy, scanning for external plug-ins, and preventing cheating, etc.).

1.8 When you interact with other players through text, voice and other means in the game, we might collect and save the content of the above information you send for filtering pornography, violence, politics, insults, malicious advertisements and other inappropriate content, in order to purify the gaming environment and maintain a healthy online environment.

1.9 If you wish to interact with other game players through voice, send questions and suggestions to us with screenshots. After obtaining your authorization, the game will access your photos or storage files, microphone, and provide you with screenshot saving, picture uploading, voice chatting and other functions.

1.10 Mobile phone number and password are personal information that you voluntarily provide to us when you choose to use your cell phone number to register/activate your account. At the same time, we need your consent to obtain the permission to read the SMS of your cell phone, and we will verify the validity of your identity by sending an SMS verification code.

1.11 If you want to contact the game customer service quickly by phone, the game will obtain your phone call permission to provide the in-game customer service system for you to directly call customer service after your authorization and consent.

1.12 In order to facilitate avatar providing and picture uploading for feedback, the game will access your camera permission and provide you with photo and screenshot storage functions after your authorization and consent.

1.13 If you want to recommend the game to your friends and family, the game will access your contacts (read contacts) to provide you with the game-sharing function after your authorization and consent.

1.14 If you wish to interact with nearby game players, we will collect your geographic location information (e.g., IP address, GPS location, WLAN access point and Bluetooth that can provide the relevant information, and acquire sensor information) to search for nearby game players, so as to allow you to match with and team up with nearby players. Geographic location information is sensitive information, and refusal to provide such information will only result in your inability to interact with nearby game players, but will not affect your normal use of other features of Fishing Frenzy: Sea World, and you may cancel your authorization of geographic location information at any time.

1.15 In order to realize the purpose of inviting friends to play the game together, the game app will read your clipboard data when it starts, including group ID, room ID, inviter ID and other information.

1.16 According to relevant laws and regulations and national standards, we might collect and use your relevant personal information without seeking your authorization and consent in the following cases:

1) Directly related to national security, national defense security, and other national interests; directly related to public safety, public health, public knowledge, and other major public interests.

2) Directly related to crime investigation, prosecution, trial, and judgment execution.

3) For the purpose of safeguarding the life, property, reputation, and other important legal rights and interests of you or other individuals, but it is difficult to obtain your consent.

4) The collected personal information is voluntarily disclosed to the public by yourself.

5) The personal information is collected from legitimate publicly disclosed information, like legitimate news reports, government information disclosure, and other channels.

6) Necessary for the conclusion and fulfillment of a contract at your request.

7) Necessary for maintaining the safe and stable operation of the products or services provided, such as discovering and processing product or service failures.

8) Necessary for carrying out legitimate news reporting.

9) Necessary for carrying out statistical or academic research in the public interest, and to de-identify personal information contained in the results of academic research or descriptions when they are provided to the public.

10) Other cases stipulated by laws and regulations.

1.17 Please understand that the functions and services we provide to you are constantly updated and developing, and if a certain function or service is not in the foregoing description and collects your information, we will separately explain the content, scope, and purpose of the collection of information to you by means of page prompts, interactive processes, website announcements, etc., in order to obtain your consent.

At present, except for collecting game research information from third-party research organizations to help us improve our game products, we will not actively obtain your personal information from third parties outside of this game. If we need to obtain your personal information indirectly from a third party outside the game for business development in the future, we will make clear to you the source, type, and scope of use of your personal information before obtaining it, and if we need to carry out personal information processing activities for conducting our business beyond the scope of the authorization and consent that you originally gave to the third party outside Fishing Frenzy: Sea World for the provision of your personal information, we will obtain your explicit consent before processing your personal information. In addition, we will strictly comply with relevant laws and regulations and require the third party to ensure the legitimacy of the information it provides.

1.18 You (the user) understand and agree that in order to provide you with better products/services and experience, we may provide your real-name authentication information, including your name, ID card number, and cell phone number, to the third-party service organization we commissioned to validate the authenticity of the authentication information provided by you. The third-party service organization we work with may use your information for comparison with external legitimate databases for verification results. In order to ensure the security of your information, we will require the third-party partner organization to have sufficient data security capabilities and provide an adequate level of security protection. Without your consent, we will not use the information you provide for any other purpose not expressly authorized by you.

2. Storage of information

2.1 How and for how long information is stored

We store your information in secure ways, including local storage (e.g. data caching using an app), databases, and server logs.

We strictly abide by the laws and regulations as well as the agreement with the users, and use the collected information in accordance with this policy and the User Service Agreement in order to provide you with better services.

4.1 Rules of Information Use

We will use the collected information in accordance with the following rules:

 

1) We will provide you with various features and services based on the information we collect, including basic game features, player interaction features and consumption features.

2) We will analyze the operation of our products based on the frequency and circumstances of your use of Fishing Frenzy: Sea World, fault information, and performance information to ensure the safety of our services and to optimize our products and improve the quality of our services. We do not combine the information we store in our analysis software with the personally identifiable information you provide.

4.2 Method of obtaining consent after notification of the purpose of the change

We will use the information collected for the purposes covered by this policy. If we use your personal information beyond the scope that is directly or reasonably related to the purpose for which it was collected, we will inform you again and obtain your express consent first.

5. External Provision

5.1 At present, except for the circumstances stipulated in this policy and the User Service Agreement, we will not actively share, provide, or transfer your personal information to third parties outside Fishing Frenzy: Sea World. If there are other circumstances of sharing, providing, or transferring your personal information, or you need us to share, provide, or transfer your personal information to third parties outside Fishing Frenzy: Sea World, we will directly seek your consent or confirm that the third party has obtained your consent to the above actions.

5.2 We will try to contact the guardians of suspected minors after they have made purchases or confirm with them through operational channels, and then inform their guardians of the relevant consumption record information or pass it on to their guardians through the channels for reminder, confirmation, and processing.

5.3 In order to enhance your user experience, we may need to share information that has been anonymized or de-identified with third-party partners, and require them to strictly comply with our data privacy protection measures and requirements, including but not limited to processing in accordance with the Data Protection Agreement, the Commitment Letter and the relevant data processing policies, to avoid identifying individuals and to safeguard privacy and security.

We will not share information that can be used to identify you personally (e.g. your name or email address) with our partners unless you expressly authorize us to do so.

5.4 We will not publicly disclose the personal information we collect, except as otherwise provided in this policy and the User Service Agreement. If public disclosure is necessary, we will inform you of the purpose of the public disclosure, the type of information to be disclosed, and the sensitive information that may be involved, and obtain your express consent.

5.5 As our business continues to develop, we may engage in transactions such as mergers, acquisitions, asset transfers, etc. We will inform you of the relevant circumstances and continue to protect or require the new controller to continue to protect your personal information in accordance with laws, regulations and standards no less stringent than those required by this policy.

5.6 In accordance with relevant laws and regulations and national standards, we may share, transfer, and publicly disclose personal information without obtaining your prior authorization and consent in the following cases:

6. Your Rights

You have the right to inquire about personal information, delete personal information, correct personal information, withdraw consent, deactivate accounts, etc., as detailed below. You are aware and understand that the settings from different channels may vary, and the details are subject to the display of your game interface. If you are unable to operate on your own, you can also contact customer service for advice and assistance.

6.1 Inquiry of personal information

6.2 Delete Personal Information

In the following cases, you can tap on "Customer Service" at the bottom of the page to make a request to delete your personal information:

1) If our handling of your personal information violates laws and regulations.

2) If we collect or use your personal information without your consent.

3) If our handling of your personal information violates our agreement with you.

4) If you no longer use our products or services, or if you deactivate your account.

5) if we no longer provide products or services to you.

If we decide to respond to your request for deletion, we will also notify the entities that received your personal information from us at the same time and ask them to delete it promptly, unless otherwise required by law or regulation, or those entities are independently authorized by you.

When you delete information from our Services, we may not immediately delete the corresponding information in our backup system, but will delete the information when the backup is updated.

6.3 Correction of Personal Information

1) You can correct your avatar, nickname, and gender by tapping the avatar icon in "My Profile".

2) You can change your login password by tapping your avatar icon and "Change Password".

6.4 Withdrawal of Consent to Collect Personal Information

Each game feature requires your authorization and consent to the collection of some basic personal information in order to be completed. You can give or withdraw your consent to the collection and use of additional personal information at any time.

You can do this on your own by tapping "Settings" at the bottom of the page, tapping "Privacy Settings", finding "Permission Settings", and after entering the "Go to Settings" page, tap "Permissions" and choose to turn on or off the corresponding information collection permissions, or change the scope of your authorization for us to continue to collect information or withdraw your authorization through turning off the functions of your device or other ways.

When you withdraw your consent, we will no longer process the corresponding personal information. However, your decision to withdraw your consent will not affect the processing of personal information previously carried out on the basis of your authorization.

6.5 Way to deactivate your account

Once your game account is deactivated, unless otherwise specified by laws, regulations, or the Agreement, your personal information under the account will be deleted or anonymized, and will no longer be associated with the related products and services. Account deactivation is irreversible, so please proceed with caution.

If, after careful consideration, you still decide to deactivate your game account, you must read and fully understand this Game Account Deactivation Agreement ("Agreement") and agree to all its contents, especially the disclaimers and limitation clauses (such as Article 1 and Article 3.3) and the methods of dispute resolution and jurisdiction clauses (Articles 4.2, 4.3, and 4.4). These clauses may be highlighted for your attention in bold, colored text, or other reasonable means. This agreement is entered into between you and [Homeland Interactive Entertainment & Technology Limited] ("we", "our", or "us") and has a contractual effect. By starting the deactivation process according to our deactivation procedures or by checking the Deactivation Agreement and proceeding to the next step, you are deemed to have agreed to and shall abide by all the contents of this agreement.

To ensure the successful completion of the deactivation, please do not log into the game with the account during the processing period of your deactivation request. Otherwise, you are deemed to have withdrawn your deactivation request.

If you wish to use our services again after deactivation, you are welcome to re-register and log in through an account created by recognized channels (accounts that support user login will be provided by the game).

1. You understand and agree that once your game account is deactivated, it may result in, but is not limited to, the following consequences, and you must bear the responsibility for them:

1.1 You will no longer be able to log in or use the game account, and your friends will not be able to interact with you within the game.

1.2 Since game accounts may be logged in from multiple devices, all login information for the same account will be deactivated. Unless otherwise specified by laws, regulations, or the Agreement, your personal information under the account will be deleted or anonymized. You will no longer be able to retrieve your personal information, nor can you request that we recover it. This personal information includes, but is not limited to, your avatars, nicknames, achievements, in-game purchases and spending records, geographic location, and other data.

If your account was subject to a suspension or other penalties for violating national laws, regulations, or platform-related policies, we may retain data related to the account's violations for at least 180 days upon deactivation to protect the legal rights and interests of you and other relevant parties. During the retention period, we will only use this data to protect these rights and interests and will not use it for other purposes.

1.3 You understand that after the game account is deactivated, all related game earnings will be deleted. Therefore, we remind you to handle your in-game earnings before deactivating your account or ensuring that they have been settled. Once your game account is deactivated, any in-game earnings (including those accrued during your game time and potential future earnings) will be considered voluntarily forfeited. We will have the right to delete all game earnings under this account, and you will bear the consequences. You agree not to request us to restore or compensate for these game earnings. These game earnings include, but are not limited to: user rights, levels, all data related to character growth and upgrades (including but not limited to experience points, honor points, reputation points, titles, etc.), unused in-game virtual currency, virtual items (such as fish coins, crystals, items, etc.), purchased but unexpired services, and other in-game earnings that have been generated but not fully used as well as expected future earnings.

1.4 Game deactivation is irreversible. Even if you re-register with the same account through recognized channels, it will be treated as a new user account. Therefore, we kindly remind you to back up any important content before submitting the deactivation request.

1.5 Game account deactivation does not affect the obligations or responsibilities that you incurred while using the game before deactivation. You are still responsible for any actions under the game account prior to deactivation, including, but not limited to, breach of contract, damage compensation, and performance of obligations.

1.6 Other potential consequences arising from the account deactivation.

2. Before submitting/proceeding with your request to deactivate your game account, to protect the security of your account and related rights and interests, you must check and ensure that the game account meets the following conditions, including but not limited to:

2.1 You legally own and use the game account, and it complies with the platform agreements and rules regarding game accounts.

2.2 The account is in a secure and normal state, with no actions involving sensitive information, such as enabling two-factor authentication or password-free operations, taken for two weeks prior to your deactivation request. Additionally, the account has been in regular use with no risk of theft. Additionally, the account is not under any penalties (such as suspension or other actions due to violations of the game's agreements or rules).

2.3 All in-game earnings under the account have been settled or properly handled. This includes, but is not limited to, fish coins, crystals, items, trial cards, and other in-game earnings. Please ensure you handle these properly, as failure to do so will be considered a voluntary forfeiture.

2.4 There are no unfinished orders under the game account. This includes, but is not limited to, orders for virtual in-game currency, virtual items, or merchandise generated by the account.

2.5 The game account has no ongoing disputes, including complaints, investigations by government agencies, arbitration, litigation, or other disputes.

2.6 Any other conditions published by the game's official channels.

You may attempt to resolve the above issues yourself first. If you are unable to resolve them or encounter any questions during the process, please contact customer service for assistance.

3. How to Deactivate Your Game Account?

(1) You can cancel your Fishing Frenzy: Sea World game account to ensure that the game no longer collects your personal information. You can follow the account cancellation guidelines provided by the game official, and should ensure that you meet the relevant conditions of the game account cancellation announced by the game official, and agree to the "Game Account Deactivation Agreement" and other relevant rules announced by the game official. Before canceling your account, we will verify your personal identity, account security status, commonly used devices, and other information. The act of canceling your account is an irreversible act. Once the cancellation is successful, we will delete or anonymize all information about your account and ensure that such information will not be disclosed, at the same time, you will not be able to use Fishing Frenzy: Sea World game services, so please proceed with caution.

3.2 You have agreed to all the contents of the Deactivation Agreement. Additionally, you have checked and confirmed that you meet the requirements outlined in Article 2 of the Agreement.

3.3 After completing Article 3.2, to further protect your legal rights and interests, we reserve the right to verify whether you meet some or all of the deactivation conditions specified in Article 2 of the Agreement. In order to complete the verification, we will assess your account's security status and your usage of related products and services to determine if your account meets the deactivation criteria. To ensure the security of your account and your property rights and interests, we reserve the right to conduct identity verification for the deactivation request to confirm that you are the authorized user of the game account. If we find, after our assessment, that the account does not meet the deactivation conditions or if the identity verification fails, your deactivation may be unsuccessful, and you may follow our instructions for further action or contact customer service for assistance. Even if we determine that you meet the deactivation conditions, it is done through a procedural review based on your word of honor (i.e., your affirmation that the game account meets the aforementioned deactivation conditions). You remain responsible for ensuring that the game account meets the above deactivation conditions, and we do not assume any legal responsibility for this.

3.4 Follow the official instructions to delete your account on the account settings page.

Confirm and agree to all terms of this agreement, while ensuring you meet the deletion requirements above.

We will review your account status and complete the deletion after a cooling-off period of 15 business days. (Please do not log in during the period, or your deletion request will be canceled.)

If the review or authentication fails, the deletion cannot be completed. You can follow the instructions for the next steps or contact customer support.

However, please note that if you log into and use the game with the account during the agreed deactivation processing period, you are deemed to have withdrawn your deactivation request. At the same time, you understand and agree that, before deleting or anonymizing personal information associated with the account, time is needed to appropriately organize and process the information to maximize the protection of your and other users' legal rights and interests. Therefore, there may be a delay in deleting or anonymizing the personal information associated with the account.

3.5 You understand and agree that during your request for account deactivation, if we need to verify related transactions, complaints, or other matters related to your account, or if we have other reasonable grounds, we reserve the right to freeze your deactivation request and suspend the deactivation services.

 

4. Others

4.1 This agreement is part of the User Agreement ("the main agreement"), and any matters not addressed in this agreement are applicable under the main agreement. In the event of any inconsistencies between this agreement and the main agreement, this agreement shall prevail. You also understand and agree that even if your game account is deactivated, it does not relieve or exempt you from any responsibilities you may need to bear under relevant laws, regulations, agreements, or rules.

4.2 The formation, effectiveness, execution, interpretation, and dispute resolution of the Agreement shall be governed by the laws of the country/region where the service operator is located (excluding contents in conflict with laws).

4.3 In the event of any dispute or controversy arising between you and us under the Agreement, both parties shall first attempt to resolve it through amicable negotiations. Should negotiations fail, you agree to submit the dispute or controversy to the judicial authorities in the country/region where the service operator is located.

4.4 If you encounter any issues during the account deactivation process that you cannot resolve or have any questions during the process, you may contact customer service for assistance.

 

6.6 Obtaining Copies of Personal Information

If you have the need to inquire, copy, correct, supplement, delete your personal information in the game, or obtain a copy of your personal information, you can contact [homelandhk@icloud.com] to do so.

 

6.7 Responding to your request for rights

《用戶服務協議》(以下簡稱「本協議」)由您與【HOMELAND INTERACTIVE TECHNOLOGY & ENTERTAINMENT PTE. LTD.】公司(以下簡稱「我們」)共同締結,本協議具有合約效力。請您務必審慎閱讀、充分理解各條款內容,特別是免除或限制我們責任的條款、對使用者權利進行限制的條款、約定爭議解決方式和司法管轄的條款,以及開通或使用某項服務的單獨協議。前述限制、免責及爭議解決方式和管轄條款可能以黑體加粗或其他合理方式提示您注意。

除非您已閱讀並接受本協議所有條款,否則您無權使用該遊戲服務。如果您對本協議或本遊戲有意見或建議,可與遊戲客服聯繫,我們將給予您必要的協助。您點選同意、接受或下一步,或您註冊、使用歡樂捕魚場遊戲服務均視為您已閱讀並同意簽署本協議。如您為未成年用戶,請在監護人的陪同下閱讀同意本協議全部內容後方可使用本遊戲。

一、【定義】

1.1 本協議:指本協議正文、《隱私權保護政策》、遊戲規則及其修訂版本。上述內容一經正式發布,即為本協議不可分割的組成部分。

1.2 遊戲規則:指遊戲服務提供者不時發布並修訂的關於遊戲的使用者守則、玩家條例、遊戲公告及通知等內容。

1.3 遊戲服務提供者:指向您提供遊戲及其服務的【HOMELAND INTERACTIVE TECHNOLOGY & ENTERTAINMENT PTE. LTD.】公司,在本協議中簡稱為「我們」。

1.4 本遊戲:指由【HOMELAND INTERACTIVE TECHNOLOGY & ENTERTAINMENT PTE. LTD.】公司負責營運的歡樂捕魚場遊戲的統稱,包括電腦用戶端遊戲、網頁遊戲、HTML5遊戲(H5遊戲)、行動終端遊戲以及其他形式的遊戲,歡樂捕魚場遊戲可能以軟體形式提供,這種情況下,遊戲還包括該相關軟體及相關文件。

1.5 遊戲服務:指【HOMELAND INTERACTIVE TECHNOLOGY & ENTERTAINMENT PTE. LTD.】公司向您提供的與歡樂捕魚場遊戲相關的各項線上營運服務。

1.6 您:又稱“玩家”或“使用者”,指被授權使用歡樂捕魚場遊戲及其服務的自然人。

1.7 遊戲數據:指您在使用歡樂捕魚場遊戲過程中產生的被伺服器記錄的各種數據,包括虛擬物品數據、遊戲日誌、安全日誌等數據。

二、【協議的變更和生效】

2.1我們有權在必要時變更本協議條款,並在相關頁面進行通知。您可以在歡樂捕魚場遊戲的相關頁面查閱最新版本的協議條款。

2.2本協議條款變更後,如果您繼續使用歡樂捕魚場遊戲服務,即視為您已接受變更後的協議。如果您不接受變更後的協議,應停止使用本遊戲。

三、【遊戲帳號】

3.1 您如果需要使用和享受歡樂捕魚場遊戲,則您需要註冊享有使用權的遊戲帳號,並依照國家法律法規的相關要求,登入實名註冊系統並進行實名註冊。您進行實名註冊時,應提供有關您本人真實、合法、準確、有效的身份信息及其他相關信息,且不得以他人身份資料進行實名註冊。否則,我們有權終止為您提供本服務,並有權對您的遊戲帳號採取包括但不限於警告、限製或禁止使用遊戲帳號全部或部分功能、刪除遊戲帳號及遊戲資料、刪除相關資訊、遊戲帳號封禁(以下簡稱「封號」)直到註銷的處理措施(為描述方便,以下有時也將此等處理措施稱為「處罰」),因此造成的一切後果由您自行承擔,且我們有權要求您賠償由此帶給我們的所有損失。

3.2 如您使用我們認可的第三方帳號作為遊戲帳號使用和享受歡樂捕魚場遊戲的,您還應遵守有關該第三方帳號的協議、規則,且因該第三方帳號產生的相關問題包括但不限於被竊等,您應自行聯絡該第三方進行解決,我們可視情況提供相應的協助。

3.3 您充分瞭解並同意,我們有權審查使用者註冊所提供的身份資訊是否真實、有效,並應積極採取技術與管理等合理措施保障使用者帳號的安全、有效;使用者有義務妥善保管其帳號及密碼,並正確安全地使用其帳號及密碼。用戶未盡上述義務導致帳號密碼遺失、帳號被盜等情形而給用戶和他人的民事權利造成損害的,應承擔由此產生的法律責任。為免產生糾紛,您不得有償或無償出借或轉讓遊戲帳號。否則,您應自行承擔由此產生的任何責任,同時我們保留追究上述行為人法律責任的權利。若您發現有他人冒用或盜用您的遊戲帳號及密碼、或任何其他未經您合法授權使用的情形時,應立即以我們要求的有效方式通知我們並告知我們需採取的措施。您通知我們時,應提供與您註冊身分資訊一致的個人有效身分資訊,我們收到您的有效請求並核實身分後,會根據您的要求或結合具體情況採取相應措施(包括但不限於暫停該帳號的登入和使用等),我們因根據您的要求採取相應措施而造成您及其他使用者損失的,由您自行承擔。若您沒有提供有效識別資訊或您提供的個人有效識別資訊與所註冊的身份資訊不一致的,我們有權拒絕您的要求,因此造成您損失的,由您自行承擔。

3.4 歡樂捕魚場遊戲帳號是我們依本協議授權您用於登入、使用遊戲及相關服務的標識,其所有權屬於我們。您僅享有遊戲帳號的使用權,不得將遊戲帳號以任何方式提供給他人使用,包括但不限於不得以轉讓、出租、借用等方式提供給他人作包括但不限於直播、錄製、代打代練等商業性使用。否則,因此產生任何法律後果及責任均由您自行承擔,且我們有權對您的遊戲帳號採取包括但不限於警告、限製或禁止使用遊戲帳號全部或部分功能、刪除遊戲帳號及遊戲資料及其他相關資訊、封號直至註銷的處理措施,因此造成的一切後果由您自行承擔。

3.5 您充分瞭解並同意,若我們依照相關業務規則限制、凍結或終止您帳號的使用,可能會導致您遊戲帳號下遊戲資料及相關資訊被刪除,以及相關權益的喪失,該損失由您自行承擔,對此我們不承擔任何責任。

3.6 在歡樂捕魚場遊戲提供遊戲帳號註銷功能情形下,如您需要註銷遊戲帳號的,可按照我們提供的帳號註銷指引進行操作,並應保證滿足我們公佈的有關遊戲帳號註銷的相關條件,同時同意我們公佈的遊戲帳號註銷協議和其他相關規則。同時也特別提示您,如您註銷遊戲帳號的,該遊戲帳號下的相關遊戲收益也會被清除。據此,在您註銷本遊戲帳號前請您確保已妥善處理該遊戲帳號下的遊戲收益或相關的遊戲收益已結清。一旦您註銷本遊戲帳號,如屆時該遊戲帳號下還存在遊戲收益的(包括在本遊戲使用期間已產生的及未來可能產生的遊戲收益),我們有權對該遊戲帳號下的全部遊戲收益做清除處理,因此產生的後果由您自行承擔。前述遊戲收益包括但不限於:遊戲會員權益、等級;與遊戲角色成長升級相關的所有數據(包括但不限於經驗值、榮譽值、聲望值、頭銜等);尚未使用的網絡遊戲虛擬貨幣、虛擬道具及其他虛擬物品(如鑽石、遊戲豆、道具及其他等);已購買但未到期或未使用完的增值服務;已產生但未消耗完畢的其他遊戲收益或未來預期的遊戲收益等。

3.7帳號或暱稱,以及頭像、個人簡介等註冊資訊須遵守公共秩序和善良風俗,遵守法律法規、社會主義制度、國家利益、公民合法權益、公共秩序、社會道德風尚和資訊真實性等七條底線;不得有明確或隱含非法、騷擾性、侮辱性、恐嚇性、傷害性、破壞性、挑釁性、庸俗性、淫穢色情性等內容的文字以及其他侵犯他人合法利益和人格尊嚴的文字或圖樣;不得冒用、關聯機構或社會名人註冊帳號名稱。

四、【使用者資訊收集、使用及保護】

4.1 您同意並授權我們為履行本協議之目的收集您的用戶信息,這些信息包括您在實名註冊系統中註冊的信息、您遊戲帳號下的遊戲數據以及其他您在使用遊戲服務的過程中向我們提供或我們基於安全、使用者體驗最佳化等考慮而需收集的信息,我們對您的使用者資訊的收集將遵循相關法律的規定。

4.2 您充分理解並同意:我們或其合作的第三方可以根據您的用戶信息,通過短信、電話、郵件等各種方式向您提供關於歡樂捕魚場遊戲的活動信息、推廣信息等各類信息。

4.3 您瞭解並同意:為了更好地向您提供遊戲服務,改善遊戲體驗,我們可收集您作為遊戲帳號的官方帳號以及我們認可的其他帳號(第三方帳號)涉及的唯一識別、暱稱、頭像、好友關係以及您授權的其他信息,以及您在歡樂捕魚場遊戲中的相關操作信息、遊戲信息(具體包括但不限於您的登錄狀態、對戰信息/狀態、成就信息)並進行使用,並可向您本人或其他使用者展示該等資訊。

您知悉並同意,如國家有權機關依法要求我們協助調查您遊戲帳號(包括實名身分資訊)及遊戲相關資料(如儲值、消費、交易資料)資訊的,我們可將前述相關資訊提供給國家有權機關。

4.4 您應對透過歡樂捕魚場遊戲及相關服務了解、接收或可接觸到的包括但不限於其他使用者在內的任何人的個人資訊予以充分尊重,您不應以蒐集、複製、儲存、傳播或以其他任何方式使用其他使用者的個人訊息,否則,由此產生的後果由您自行承擔。

4.5 您有權自主選擇依照遊戲設定的方式和規則進行競賽或遊戲,但應對其遊戲活動承擔相應責任和由此產生的損失,包括經濟損失和精神損害。我們就用戶的遊戲行為、活動、交易或利用歡樂捕魚場遊戲進行的非法活動不承擔任何責任。

4.6 保護使用者資訊及隱私是我們的一項基本原則。除本協議另有規定外,我們對使用者資訊收集、使用及保護等將遵循《隱私權保護政策》等協議規定。除法律另有規定外,如您已同意或授權我們依據前述協議或規定收集、使用或處理涉及您的個人資訊的,在您撤回該同意或授權後,不影響我們在此之前已基於您的同意或授權所進行的個人資訊的收集、使用或處理,我們對先前相關個人資訊收集、使用或處理繼續有效。

五、【遊戲服務】

5.1 在您遵守本協議及相關法律法規的前提下,我們給予您一項個人的、不可轉讓及非排他性的許可,以使用歡樂捕魚場遊戲服務。您僅可為非商業目的使用歡樂捕魚場遊戲服務,包括:

(1)接收、下載、安裝、啟動、升級、登入、顯示、運行和/或截圖歡樂捕魚場遊戲;

(2)創建遊戲角色,設定網名,查閱遊戲規則、用戶個人資料、遊戲對局結果,開設遊戲房間,在遊戲中購買、使用遊戲道具、遊戲幣等,使用聊天功能、社交分享功能;

(3)使用歡樂捕魚場遊戲支援並允許的其他某一項或幾項功能。

5.2您在使用歡樂捕魚場遊戲服務過程中不得未經我們許可以任何方式錄製或向他人傳播歡樂捕魚場遊戲內容,包括不得利用任何第三方軟體進行網路傳播等。

5.3 在歡樂捕魚場遊戲以軟體形式提供的情況下,您在使用本遊戲及遊戲服務時也應符合本協議第六條關於軟體授權的規定。

5.4 本條及本協議其他條款未明示授權的其他一切權利仍由我們保留,您在行使這些權利時須另外取得我們的書面許可。

5.5 若您違反本協議任何約定的,我們有權採取本協議第7.5條規定的一種或多種處理措施,並可公佈處理結果,且(/或)有權要求您賠償因您違約行為而給我們造成的所有損失。

5.6 您充分瞭解並同意,我們有權依合理判斷對違反有關法律法規或本協議規定的行為進行處罰,對違法違規的任何用戶採取適當的法律行動,並依據法律法規保存有關信息向有關部門報告等,使用者應獨自承擔由此而產生的一切法律責任。

5.7 您充分瞭解並同意,因您違反本協議或相關服務條款的規定,導致或產生第三方主張的任何索賠、要求或損失,您應當獨立承擔責任;我們因此遭受損失的,您也應當一併賠償。

5.8 您充分理解並同意:遊戲道具、遊戲幣等是本遊戲的一部分,我們在此許可您依本協議而獲得其使用權。您購買、使用遊戲道具、遊戲幣等應遵循本協議、遊戲特定規則的要求;同時,遊戲道具、遊戲幣等可能受到一定有效期限的限制,若您在規定的有效期限內未使用,除不可抗力或可歸責於我們的原因外,一旦有效期屆滿,將會自動失效。

您充分瞭解並同意:為更好地向用戶提供遊戲服務、營造綠色健康的遊戲環境,我們有權根據監管要求、本協議約定、遊戲規則或其他我們認為有必要的情形時,我們將對您的遊戲道具作出相應處理措施,包括但不限於對相關數值設定作出調整、更新或優化、部分或全部回收清零用戶帳戶內道具、虛擬貨幣等,且如我們做出前述措施的,您同意不會因此追究我們的任何法律責任,我們亦不承擔任何法律責任。

5.9 您充分理解並同意:為營造公平、健康的遊戲環境,在您使用遊戲服務的過程中,我們有權通過技術手段了解您終端設備的隨機存儲內存以及與歡樂捕魚場遊戲同時運行的相關程式.一經發現有任何未經授權的、危害遊戲服務正常運作的相關程序,我們將收集所有與此有關的資訊並採取合理措施予以打擊。

5.10 您充分瞭解並同意:為了確保您及其他使用者的遊戲速度,我們有權定期轉移或清除遊戲伺服器上儲存的一些過往的遊戲資料。

5.11我們將依照相關法律法規和本協議的規定,為了最大限度的保護未成年人,防止未成年人過度使用甚至沉迷網路遊戲。

5.12我們提供使用者遊戲服務本身屬於商業行為,使用者有權自主決定是否根據我們自行決定的收費項目(包括但不限於購買遊戲內的虛擬道具的使用權以及接受其他增值服務等各類收費項目)及收費標準支付相應的費用,以獲得相應的遊戲服務,用戶付費完成,道具或增值服務到賬,費用無法退回。如您不按相應標準支付相應費用的,您將無法獲得相應的遊戲服務。

您知悉並同意:收費項目或收費標準的改變、調整是一種正常的商業行為,您不得因為收費項目或收費標準的改變、調整而要求我們進行賠償或補償。

5.13在任何情況下,我們不對因不可抗力導致的您在使用遊戲服務過程中所遭受的損失負責。該等不可抗力事件包括但不限於國家法律、法規、政策及國家機關的命令及其他政府行為或其它的諸如地震、水災、雪災、火災、海嘯、颱風、罷工、戰爭等不可預測、不可避免且不可克服的事件。

5.14 歡樂捕魚場遊戲可能會因遊戲軟體BUG、版本更新缺陷、第三方病毒攻擊或其他任何因素導致您的遊戲角色、遊戲戰績、遊戲幣及其他遊戲道具等遊戲資料而發生異常。在資料異常的原因未被查明前,我們有權暫時凍結該遊戲帳號;若查明資料異常為非正常遊戲行為所致,我們有權將遊戲帳號資料恢復至異常發生前的原始狀態(包括向第三方追回被轉移資料),我們無須向您承擔任何責任。

5.15 我們未授權您從任何第三方購買、接受贈與或其他的方式取得遊戲帳號、遊戲幣及其他遊戲道具、遊戲服務等,我們不對第三方交易行為(第三方交易,是指您從第三方透過購買、接受贈與或其他的方式獲得遊戲帳號、遊戲道具、遊戲幣及其他遊戲服務的行為)負責,並且不受理因任何第三方交易發生糾紛而帶來的申訴。

5.16 您充分瞭解到:不同作業系統之間存在不互通的客觀情況,該客觀情況並非我們造成,由此可能導致您在某一操作系統中的充值和遊戲數據不能順利轉移到另一操作系統中。由於您在不同系統進行切換造成的儲值損失和遊戲資料遺失風險應由您自行承擔,我們對此不承擔任何責任。

5.17 我們自行決定終止營運本遊戲時或本遊戲因其他任何原因終止營運時,我們會依照國家法律法規有關網路遊戲終止營運的相關規定處理遊戲終止營運相關事宜,以保障用戶合法權益。

六、【軟體許可】

6.1 使用遊戲服務可能需要下載並安裝相關軟體,您可以直接從我們的相關網站上取得該軟體,也可以從我們授權的第三方取得。如果您從未經我們授權的第三方獲取歡樂捕魚場遊戲或與歡樂捕魚場遊戲名稱相同的遊戲,將視為您未獲得我們的授權,我們無法保證該遊戲能夠正常使用,並對因此給您造成的損失不予負責。

6.2 我們可能為不同的終端設備開發了不同的軟體版本,您應根據實際情況選擇下載合適的版本進行安裝,下載安裝程式後,您需要按照該程式提示的步驟正確安裝。

6.3 若歡樂捕魚場遊戲以軟體形式提供,我們給予您一項個人的、不可轉讓及非排他性的許可。您僅可為非商業目的在單一終端設備上下載、安裝、登入、使用該遊戲。

6.4 為提供更優質、安全的服務,在軟體安裝時我們可能會推薦您安裝其他軟體,您可以選擇安裝或不安裝。您充分瞭解並同意:若我們依照相關業務規則限制、凍結或終止您的遊戲帳號的使用,可能會導致您遊戲帳號下遊戲資料及相關資訊被刪除,以及相關權益的喪失,該損失由您自行承擔,對此我們不承擔任何責任。

6.5 如果您不再需要使用該軟體或需要安裝新版,可以自行解除安裝。如果您願意幫助我們改進產品服務,請告知卸載的原因。

6.6 為了確保遊戲服務的安全性和功能的一致性,我們有權不經向您特別通知而對軟體進行更新,或對軟體的部分功能效果進行變更或限制。

6.7 軟體新版發布後,舊版的軟體可能無法使用。我們不保證舊版軟體繼續可用及對應的客戶服務,請您隨時核對並下載最新版本。

七、【使用者行為規範】

7.1 您充分了解並同意,您必須為自己遊戲帳號下的一切行為負責,包括您所發表的任何內容以及由此產生的任何後果。

7.2您在使用歡樂捕魚場遊戲或遊戲服務時須遵守國家法律法規,不得利用該遊戲或遊戲服務從事任何違法行為,也不得實施任何侵犯我們及其他第三方合法權益行為。具體包括但不限於以下違法行為:

(1)違反憲法確定的基本原則的;

(2)危害國家統一、主權和領土完整的;

(3)洩漏國家秘密、危害國家安全或損害國家榮譽和利益的;

(4)煽動民族仇恨、民族歧視,破壞民族團結,或侵害民族風俗、習慣的;

(5)宣揚邪教、迷信的;

(6)散播謠言,擾亂社會秩序,破壞社會穩定的;

(7)宣揚猥褻、色情、賭博、暴力,或是教唆犯罪的;

(8)侮辱、誹謗他人,侵害他人合法權益的;

(9)違背社會公德的;

(10)有法律、行政法規和國家規定禁止的其他內容的。

7.3您知悉並同意以下規則:

1.歡樂捕魚場遊戲僅供您進行娛樂活動使用,您不得利用該遊戲及相關服務從事任何營利行為,更不得利用該遊戲及相關服務從事賭博、開設賭場及其他任何違法行為,也不得為其他使用者從事前述營利或違法違規行為提供任何方便或條件。

2、除國家法律法規或政策另有規定外,對於我們遊戲中的虛擬貨幣、積分及其他虛擬道具,我們均不提供任何形式的官方回購、直接或變相兌換現金或實物、相互贈予、轉讓等服務及相關功能。

同時,您也不得違反國家以及我們公司相關規定,以任何方式在遊戲中及線下或透過其他平台進行捕魚遊戲虛擬貨幣、積分或其他虛擬道具的交易。

3、在您使用歡樂捕魚場遊戲時,我們可根據國家法律法規或政策的規定,限制您每個遊戲帳號的每局、每日消耗的遊戲幣、遊戲積分或其他遊戲虛擬道具的數量,並限定您每個遊戲帳號的每日儲值金額和遊戲時間。我們有權在符合國家規定基礎上,制定本遊戲的具體限製或限定標準。

4、您不得從事任何違法違規或侵害我們公司及其他第三方合法權益行為,包括但不限於下列行為:

(1)實施任何破壞遊戲穩定性、公平性或影響遊戲正常進行的行為,或破壞、影響遊戲服務正常進行的行為,包括但不限於;

1)違規及(或)惡意註冊、登入遊戲的行為,包括提供虛假註冊身分資訊、惡意大量註冊遊戲帳號,以及以破壞伺服器鑑權、惡意擠衣等方式登入遊戲行為;

2)惡意實施可能導致遊戲伺服器當機、卡頓,或其他遊戲玩家斷線、延遲等無法正常遊戲的行為,如利用DDOS對遊戲伺服器或其他玩家進行網路流量攻擊的行為等;

3)利用遊戲漏洞獲益(包括但不限於刷取虛擬貨幣、點數或虛擬道具)、破壞遊戲環境或造成其他玩家不良影響的行為;

4)消極遊戲破壞其他使用者遊戲體驗的行為。包括但不限於惡意損害本方隊友,惡意組隊,惡意送分,消極託管、逃跑,以及其他消極遊戲,破壞用戶遊戲體驗的行為;

5)安裝使用影響本遊戲平衡的第三方軟體的行為;

6)您的遊戲數據表現異常,影響遊戲公平的其他行為。

(2)同一玩家(或同一IP,或同一實體位址)註冊或登入多個遊戲帳號;

(3)遊戲對局中採取「雙簧作弊」、投注後或對局中故意逃跑導致遊戲幣、遊戲積分或其他虛擬道具輸給其他玩家、不合理拖延對局或比賽時間而影響遊戲公平性等作弊行為;

(4)以某種方式暗示或偽稱我們內部員工或某種特殊身份,企圖得到不正當利益或影響其他使用者權益的行為;

(5)在遊戲中使用非法或不當字詞、字元等,包括用於角色命名;

(6)各種私服、外掛行為;

(7)散播非法言論或不當訊息;

(8)盜取他人遊戲帳號、遊戲物品;

(9)進行遊戲帳號交易、帳號共享等影響帳號安全的行為;

(10)在未經我們授權或認可的折扣管道進行遊戲充值,或委託未獲我們授權或認可的第三方代為充值,或使用未經我們授權或認可的第三方軟體充值。

(11)其他在業界被廣泛認可的不當行為;

(12)其他違反法規規定、侵犯其他使用者合法權益、幹擾本遊戲正常運作或我們未明示授權的行為。

您知悉並同意,由於外掛具有隱蔽性或用完後即消失等特點,我們有權根據您的遊戲數據和表現異常判斷您有無使用非法外掛等行為。

7.4除非法律允許或我們書面許可,您不得從事下列行為:

(1)刪除遊戲軟體及其副本上關於著作權的資訊;

(2)對遊戲軟體進行反向工程、反向彙編、反向編譯或以其他方式嘗試發現軟體的原始碼;

(3)對遊戲軟體進行掃描、探查、測試,以偵測、發現、尋找其中可能存在的BUG或弱點;

(4)對遊戲軟體或軟體運行過程中釋放到任何終端記憶體中的數據、軟體運行過程中客戶端與伺服器端的交互數據,以及軟體運行所必需的系統數據,進行複製、修改、增加、刪除、掛接運作或創作任何衍生作品,形式包括但不限於使用外掛程式、外掛程式或非經合法授權的第三方工具/服務存取軟體和相關係統;

(5)修改或偽造軟體運作中的指令、數據,增加、刪減、變動軟體的功能或運作效果,或將用於上述用途的軟體、方法進行運作或向公眾傳播,無論上述行為是否為商業目的;

(6)透過非我們開發、授權的第三方軟體、外掛程式、外掛程式、系統,使用歡樂捕魚場遊戲及遊戲服務,或製作、發布、傳播非我們開發、授權的第三方軟體、外掛程式、外掛程式、系統;

(7)對遊戲中我們擁有知識產權的內容進行使用、出租、出借、複製、修改、連結、轉載、彙編、發表、出版、建立鏡像網站等;

(8)建立有關遊戲的鏡像站點,或進行網頁(絡)快照,或利用架設伺服器等方式,為他人提供與遊戲服務完全相同或類似的服務;

(9)將歡樂捕魚場遊戲的任意部分分離出來單獨使用,或進行其他的不符合本協議的使用;

(10)使用、修改或遮蓋遊戲的名稱、商標或其它知識產權;

(11)其他未經我們明示授權的行為。

7.5如您違反本協議第7.2條、第7.3條或第7.4條任何內容的,或違反本協議其他任何約定的,我們有權視情節嚴重程度,採取以下一種或多種處理措施:

(1)警告;

(2)刪除違法違規資訊;

(3)取消、刪除或追回您遊戲帳號因違反本協議約定而獲得的相關虛擬貨幣、虛擬道具或獎勵(如遊戲幣、遊戲積分、參賽資格、獲獎名次及獎勵等);

(4)將遊戲帳號資料恢復至異常發生前的原始狀態(包括向第三方追回被轉移資料);

(5)刪除遊戲全部或部分資料;

(6)限製或禁止使用遊戲全部或部分功能;

(7)暫時或永久禁止登入(即封號);

(8)中止或終止為您提供遊戲服務;

(9)依法移交有關行政管理機關給予行政處罰,或依法向有關機關報案追究刑事責任。

7.6 您知悉並同意:如我們依據本協議對您的遊戲帳號採取封號處理措施的,具體封號期間由我們根據您違規行為情節而定。

您知悉並同意:(1)在封號期間,您遊戲帳號中的遊戲虛擬貨幣、遊戲幣、遊戲裝備及其他遊戲虛擬道具可能都將無法使用;(2)如前述遊戲虛擬貨幣、遊戲幣、遊戲裝備及其他遊戲虛擬道具存在一定有效期,該有效期可能會在封號期間過期,您遊戲帳號解封後,您將無法使用該等已過期的遊戲虛擬貨幣、遊戲裝備、遊戲幣及其他遊戲虛擬道具。
